In the Catholic Church, those who divorce must obtain an annulment of the previous marriage in a church court. This is absolutely necessary in order to remarry.

In Judaism, in order to divorce, the parties must appear before a Beth Din, or religious court, consisting of three rabbis. After ascertaining that the couple cannot reconcile their differences, the Beth Din will issue a divorce decree or get. With the parties’ agreement, the Beth Din may also be authorized to resolve other issues such as division of assets like any other arbitrator. Any award by the Beth Din would need to be confirmed in a civil court and a civil divorce would still need to be obtained. The get, however is not valid until the husband voluntarily delivers it to the wife in front of witnesses and she accepts it. Where the husband fails to deliver a get, the wife is deemed an agunah, or one who is chained to the marriage. Remarriage, without a get is considered adultery and is forbidden by Jewish Law.

Islamic laws regarding divorce are also complicated in that women do not have equal rights. Though it is discouraged, Islam gives the husband the right to divorce his wife. But unlike Judaism, the wife is given the right to dissolve a marriage through what is called Khula.
